• That any fitness programme will be suitable for every individual
• The completeness or medical accuracy of general health-related information provided

Nothing in this section excludes or limits liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot lawfully be excluded under UK law

4. Member Responsibilities

By becoming a member of Vybe Fitness, you agree that:

• You will consult a qualified and registered medical professional before beginning any new exercise programme, particularly if you have pre-existing health conditions

• You will not rely on gym-provided information, assessments, or digital communications as a replacement for independent medical judgment
• You acknowledge that digital systems, booking platforms, access control systems, and communication tools may occasionally experience technical errors, service interruptions, or delays

Members are responsible for exercising within their own physical limits and for immediately stopping any activity that causes pain, discomfort, dizziness, or distress.

Failure to provide accurate health information or to follow safety guidance may increase the risk of injury and may affect liability protections available under applicable law.

5. Limitation of Liability

To the fullest extent permitted by the laws of England and Wales, Vybe Fitness by VYBE FITNESS LTD shall not be liable for:

• Loss of profits, revenue, business opportunity, goodwill, or anticipated savings
• Loss, corruption, or unauthorised access to data

Our total aggregate liability to you for any claim arising out of or in connection with your membership, use of our facilities, or use of our digital systems shall be limited to:

• The total membership fees paid by you to Vybe Fitness in the 12 months preceding the event giving rise to the claim.

• Behaviour that is unsafe, abusive, unlawful, or disruptive to staff or other members

Where appropriate, we may suspend access while investigating a potential breach.

Termination or suspension does not affect any rights or obligations that have accrued prior to termination, including outstanding payment obligations.

Nothing in this clause limits any statutory rights you may have under applicable UK consumer law, including cancellation rights where legally required.
